Could Your Parking Fine Be Invalid?

A man who has won an appeal for a parking fine that was issued to him at Wednesday Market is urging others to do the same, as they could be entitled to a refund.

Philip Nixon from Driffield was not driving his car when it was issued with a parking ticket on the pedestrian area of Wednesday Market.

As there was no ticket on the car Mr. Nixon put in an appeal which he won revealing a loop hole he wants to alert other drivers to.

Speaking to HU17.net Mr. Nixon said;

“Not being the driver that day I had no knowledge of the matter so took it up with the driver of the vehicle who said as far as he knew there were no restrictions where he was parked as there were no markings on the road or pavement area.”

“When I received the Notice To Owner which is sent out to the registered keeper of the vehicle if no payment has been made within the 14 day period, I read through the process.

“I received a Notice of Acceptance of Representations from East Riding of Yorkshire Council that said basically the ticket had been correctly issued by the CEO and they provided the photos to show the ticket on the vehicle.”

“They then went on to explain why there were no markings on the road  which is allowed IF they have an exemption from the Department of Transport allowing them to not put Yellow lines down on the road especially as this was a pedestrian area.

“However upon investigating this it has transpired that East Riding Council do not have this exemption certificate which therefore makes the PCN invalid and any other tickets issued by ERYC in that area.”

“This is a game changer for possibly hundreds of motorists that have been issued tickets in this area, effectively meaning that those motorist that have paid their tickets can seek Restitution and claim their money back because the tickets were issued incorrectly.”

“I would like to urge any motorist who has received a ticket under a code ‘02’ issued to them at Wednesday Market to appeal as they should get a full refund.”

A spokesman for East Riding of Yorkshire Council said:

“The officer who served the parking penalty notice selected the wrong contravention code for the parking offence being committed.”

“The code that was selected required a specific set of signs and lines to be in place before enforcement could be carried out. Since these were not present the parking notice was cancelled upon appeal.”
